1. Introduction

Ambi Laboratories Inc. ("Ambi Labs," "we," "us," or "our"), the maker of Wink (the "Service"), respects your privacy and is committed to protecting your personal information. This Privacy Policy explains what information we collect, how we use it, who we share it with, and the rights and choices you have. It applies to our website, applications, and related services (collectively, the "Services").

2. Information We Collect

We collect the following categories of information:

  • Account Information. Name, work email, organization, and authentication identifiers when you create or sign in to an account.
  • Customer Identity & Contact Details. When our business customers use Wink during a live shopping session, we process information about their end shoppers, including name, email address, phone number, and postal or shipping address. This information is provided by the merchant from their customer records or shared during the call.
  • Order & Purchase History. Past orders, returns, items pinned or attached during the call, and products discussed with the shopper, sourced from the merchant's commerce backend.
  • Live Call Audio & Transcripts. When enabled by the merchant, we receive the live audio of the shopping call and generate a real-time transcript so Wink can suggest products, surface customer context, and assist the agent. Merchants are responsible for obtaining any consent required from end shoppers under applicable call-recording and wiretap laws.
  • Content You Provide. Audio, text, files, prompts, chat messages with the Wink assistant, and other content you submit to or generate through the Services.
  • Usage Data. Device, browser, IP address, log data, feature usage, and diagnostic information collected automatically when you use the Services.
  • Cookies and Similar Technologies. Cookies, local storage, and similar technologies used to operate, secure, and improve the Services.
  • Communications. Messages you send us, support requests, and related metadata.

For end-shopper information processed during live sales sessions, the merchant is the data controller and Ambi Laboratories Inc. acts as a processor on the merchant's behalf.

3. How We Use Information

We use information to:

  • Provide, maintain, secure, and improve the Services;
  • Authenticate users and protect against fraud, abuse, and unauthorized access;
  • Process transactions and provide customer support;
  • Communicate with you about updates, security alerts, and administrative messages;
  • Analyze usage and improve product performance, reliability, and features;
  • Comply with legal obligations and enforce our Terms of Service.

We do not sell your personal information, and we do not use your content to train foundation models without your explicit consent.

4. Legal Bases for Processing

Where the GDPR or similar laws apply, we process personal information based on the following legal bases: performance of a contract, our legitimate interests (such as securing and improving the Services), compliance with legal obligations, and your consent where required.

5. How We Share Information

We share information only as necessary and with appropriate safeguards:

  • Compliance and Safety. When required by law, legal process, or to protect the rights, safety, and property of Wink, our users, or others.
  • Business Transfers. In connection with a merger, acquisition, financing, or sale of assets, subject to standard confidentiality protections.
  • With Your Direction. When you authorize us to share your information with a third party.

6. International Data Transfers

We operate globally and may transfer, store, and process your information in countries other than your own. Where required, we use approved transfer mechanisms such as Standard Contractual Clauses to ensure your information receives an adequate level of protection.

7. Data Retention

We retain personal information only for as long as necessary to provide the Services, comply with legal obligations, resolve disputes, and enforce our agreements. Retention periods vary based on the type of information and the purposes for which it is processed. When information is no longer needed, we delete or de-identify it.

We implement administrative, technical, and physical safeguards designed to protect personal information, including encryption in transit and at rest, access controls, and regular security reviews. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

The Services are not directed to children under 13 (or the equivalent minimum age in your jurisdiction), and we do not knowingly collect personal information from them. If you believe a child has provided us with personal information, please contact us and we will take appropriate steps to delete it.

11. Third-Party Links and Services

The Services may contain links to third-party websites and services that we do not control. This Privacy Policy does not apply to those third parties, and we encourage you to review their privacy policies before providing any personal information.

12. Changes to This Policy

We may update this Privacy Policy from time to time. When we make material changes, we will notify you by updating the "Last Updated" date and, where appropriate, by additional notice such as email or in-product notification. Your continued use of the Services after the changes take effect constitutes acceptance of the revised policy.
